The Lahore High Court has reaffirmed an important legal principle under Articles 59 and 84 of the Qanun-e-Shahadat Order, 1984, emphasizing that:
In cases where the authenticity of a document is in dispute particularly when forgery is alleged , the courts must seek expert opinion and utilize modern forensic tools to uncover the truth. Judicial discretion should be exercised to uphold substantive justice over mere procedural technicalities, even if the alleged signatory has passed away.
Rejecting forensic examination in such matters amounts to a miscarriage of justice.
