We are pleased to announce that Our Senior Partner Adnan Ali Khero, with assistance of our name Partner Touseef Shafique, in Criminal Case No. 85 of 2025 (arising out of FIR No. 57 of 2025, P.S. Bakrani), registered under Sections 337-A(i), 337-F(v), 337-F(i), 504, 506-II, 148 and 149 PPC, the Honourable Court of Civil Judge & Judicial Magistrate-I, Larkana, acquitted the accused persons namely Aajid @ Aajiz Ali, Amber, Inam, Ansar, Ghulam Nabi, Athar, Izhar and Atif Ali (Juvenile) after a full-fledged trial vide judgment dated 10-04-2026.
As per the prosecution case, on 06.06.2025 at about 09:30 a.m. at Bhagat Chowk, Deh Shaikh Fojo, the accused persons, allegedly forming an unlawful assembly and armed with lathis, assaulted the complainant party. It was alleged that accused Aajiz Ali caused a lathi blow to Shoaib, brother of the complainant; accused Ghulam Nabi inflicted lathi blows on the complainant’s head and right hand; accused Inam caused a lathi blow on the complainant’s left elbow, while the remaining accused persons allegedly caused lathi, fist and kick blows, resulting in injuries to the complainant party.
After conducting a comprehensive trial and thoroughly examining the evidence produced by the prosecution, the Honourable Court found that the prosecution had failed to establish the guilt of the accused persons beyond reasonable doubt. Owing to material contradictions, inconsistencies and deficiencies in the prosecution evidence, the Court extended the benefit of doubt to the accused persons and acquitted them of the charges.
This judgment reaffirms the settled principle of criminal jurisprudence that the burden lies upon the prosecution to prove its case beyond reasonable doubt, and where doubt exists, the accused is entitled to its benefit as a matter of right.
