Yes, indeed, your registered trademark in Nigeria isn’t guaranteed forever. The Nigerian Intellectual Property Office allows for the revocation or cancellation of a trademark under certain conditions provided by law.

The most common reasons a trademark can be revoked are:

Non-use: If the trademark hasn’t been used continuously for three years or more.

Non-renewal: If the trademark registration isn’t renewed on time.

Other conditions exist, but non-use and failure to renew are the main grounds. This means that even if you registered your trademark, you must actively use it and keep it renewed to maintain protection.

A SCUML certificate (Special Control Unit Against Money Laundering) is basically proof that your business is not being used to clean “dirty” money.

It’s issued by the EFCC, and it’s now one of the requirements for opening or operating a corporate bank account in Nigeria.

If your business falls under what EFCC calls “Designated Non-Financial Institutions” like real estate, law firms, accounting, hospitality, dealers in luxury goods, NGOs, and even consultants, then you need one.

Banks can freeze or restrict your corporate account if you don’t have it.
Some clients (especially international ones) won’t do business with you without it.
It keeps your business compliant and protected from money laundering accusations.
