Is this true?

It is indeed a very sensational heading but it can be misinterpreted to read that such (post nuptial) agreement can be upheld by the Court.

Unfortunately pre-nuptial agreements cannot override the legislation and Court's discretion when it comes to custody, maintenance and division of assets. The Court did not follow the (post nuptial) agreement and indeed ruled on the facts of the case instead. The Court only took in to consideration that the Petitioner Wife had already knew of the third party by executing the agreement and apportioned the blame for the breakdown of marriage accordingly.
