The Industrial Court has ruled that American Express (Malaysia) Sdn Bhd wrongfully dismissed an employee who endured years of workplace bullying, harassment and intimidation by his superior.

In a 45-page award, chairman Augustine Anthony said the evidence revealed a hostile work environment where R. Kuhendran was repeatedly targeted, humiliated and eventually dismissed in a retaliatory act.

The court ordered the company to pay Kuhendran, a former senior credit specialist, RM153,200 in back wages and compensation in lieu of reinstatement.

Twelve years ago, we founded our firm together. Since then, we have faced challenges together, endured difficult times together and celebrated every achievement and milestones together. Looking back, we consider ourselves fortunate because neither of us had to face the journey alone.
Like any long partnership, there were differences in opinions, disagreements, stress, emotional moments and countless obstacles along the way. Yet, every challenge only made us stronger. No matter how difficult the situation, we always found our way back to working together with greater understanding, trust and resilience.

Being a lawyer comes with its own unique dilemmas, and over the years, we have come to understand that deeply. As lawyers, we naturally developed the habit of debating and arguing over almost everything. However, running our own firm taught us an important lesson- not every issue is meant to be argued. we learned the importance of listening. We learned the art of being patience, especially when dealing with difficult clients, opposing parties and even courts. We learned to become more objective and to analyse issues from every possible angle.

With time, we realised that the practice of law is no longer just about winning arguments. It is about achieving meaningful outcomes, serving clients effectively, managing responsibilities wisely, protecting the stability of the firm and making careful decisions every step of the way. The law evolves, businesses evolves and so do we. Even after 12 years, we are still learning every single day.

Most importantly, despite all the ups and downs, we are still enjoying the journey together.
