A Capacity Assessment Report is is a formal medical and legal document evaluating an adult’s mental and cognitive ability to make independent decisions regarding their finances, health, or personal life.

The evaluation is conducted by an authorized, designated healthcare professional and is a mandatory requirement for applying for or reviewing adult guardianship, trusteeship, and personal directives.

Under the Adult Interdependent Relationships Act, when talking about Adult Interdependent Partners a relationship of interdependence is when two people are not married to each other but share each other’s lives, are emotionally committed to each other, and function as an economic and domestic unit.

As such, Adult Interdependent Partners are two individuals living together in a relationship of interdependence.

When an estate is in probate, this means that the Court is validating a deceased individual’s Will, as well as confirming the Personal Representative’s authority to administer the estate.

Probate is essentially the process of submitting paperwork to the Court.

This results in a Grant of Probate being granted and provided to the Personal Representative, allowing them to pay debts and distribute the estate to beneficiaries.

The Court of King’s Bench of Alberta and Alberta Court of Justice have made it mandatory for parties to complete mandatory requirements before people to complete the following requirements before filing any document commencing a family law action or prior to filing a new application, or any document intended to bring the matter before the Court for relief.

These requirements include completing the Parent After Separation course, exchanging financial disclosure, attending for a form of alternative dispute resolution, and meeting with a Family Court Counsellor.
