Here is a question we ask that catches people out.

Not "do you have a will" — most people do. **Where is it, right now, and does anybody else know?**

The two answers we hear most often are "somewhere at home" and "I think the bank has it." Neither is much use to a family in the week after a death, when the original document is what has to go in and nobody can find it.

A will nobody can locate causes very much the same problem as no will at all — and it causes it at the worst possible moment, to people who are already dealing with enough.

It is a ten-minute problem to solve while you are alive and a considerable one to solve afterwards.

One practical option, and we will be straight about the condition attached to it: **where we are appointed as executor in the will, we hold the original in safe custody at no charge.** No storage fee, no annual anything. The reason we can do that is that we are the ones who will be winding the estate up, so the document needs to be with us in any event.

If that does not suit you, that is completely fine — but then tell somebody where it is. That is the part that actually matters.

Please do not go and get anything certified.

When someone dies and the estate has to be reported to the Master of the High Court, certified copies are required — and every guide out there tells the family to go and have them made. A queue at a police station or the Post Office, in the worst week of your life, to solve a problem that is not yours to solve.

Bring us the originals instead. We have a notary public in-house. We make the copies and we certify them as the Master requires them, which also means what gets lodged is right the first time.

Nothing to arrange before you come. Nothing to organise. Just bring what you have.

One exception: the will has to be the signed original. Everything else, we handle.

"How long will this take?"

Every client asks it. We will not answer it with a number.

Not because litigation is a mystery — because we would not control the answer. The court's roll is the court's. The other side's tactics are theirs. Witnesses and experts move at their own pace.

An estimate we cannot enforce is worth nothing to you on the day it is missed. Worse, it becomes a second grievance on top of the one you came in with.

Here is what we will commit to instead. We prepare every matter as if it will be litigated. We tell you where you stand, in language you can act on. We follow up persistently, which is less glamorous than a promise and considerably more useful.

And where a matter genuinely demands it, we mobilise same-day.

Working from an estate checklist that says R125,000?

It is wrong — and it has been wrong since 2014.

Where a deceased estate falls under a set value, the Master of the High Court can take a lighter route: no letters of executorship, directions instead, and usually a Master's Representative rather than an executor.

That value is R250,000. It was raised from R125,000 by GNR 920, published in Government Gazette 38238 on 24 November 2014, and it applies where the death occurred on or after that date. More than a decade later, checklists quoting the old figure are still doing the rounds — including some official ones.

If you are reporting an estate, check the figure you are working from. If it says R125,000, it is out of date.

Ours says R250,000. It is the checklist we give our own clients, it is on our website, and there is nothing to fill in.

Can a landlord change the locks if a tenant doesn't pay rent?
No. Self-help evictions are unlawful in South Africa. Taking matters into your own hands — even when the tenant is clearly in the wrong — can result in legal consequences for the landlord.
The only lawful route is through the courts. It takes time, but it protects your position.

When last did you check your will?

Marriage, divorce, the birth of a child, or a major change in assets are instances when you should review your will . There are also technical requirements that, if not followed, can invalidate the document entirely.

Getting married without signing an antenuptial contract? You'll be married in community of property by default — sharing all assets and all debts from day one. That includes your spouse's business debts.

An ANC should ideally be signed before the wedding. It can be done afterwards, but the process is more complex and costly. Every couple's situation is different.
