Legal Tip: After severe storms or flood damage, landlords and tenants should act quickly to document the property's condition. Take clear photographs, keep records of all communication, and report any damage as soon as possible. Early documentation can be crucial where disputes arise regarding responsibility for repairs, insurance claims, or rent reductions.

Tenants should avoid withholding rent without first obtaining legal advice or reaching an agreement with the landlord. Even where force majeure or storm damage affects the property's occupation, the appropriate remedy is often a negotiated rent remission rather than non-payment. The specific rights and obligations of both parties will ultimately depend on the lease agreement and the circumstances surrounding the damage.

When a court goes beyond the matter placed before it, who pays the price?

This case involved a child with severe cerebral palsy. The parties had worked hard to reach a settlement — quantum was agreed, liability was apportioned, and all that remained was confirmation. Then the High Court intervened without being asked to do so.

The court raised fee disputes that were never part of the matter and issued orders against attorneys who were not parties to the proceedings. The result: the settlement was delayed, and a profoundly disabled child's lifelong care trust was put at risk.

The Supreme Court of Appeal made it clear: courts supervise. They do not control. And vulnerable litigants must not pay for judicial error.
