Spotting an irregular sick note is the easy part. Knowing what to do next — legally — is where many employers get it wrong.

Dismissing an employee for submitting an irregular medical certificate is not as straightforward as it may seem. The critical question is not whether the certificate was irregular, but whether the employee knew it was. And the burden of proving that rests with the employer.

Two recent cases draw the line clearly. In one, dismissal was upheld because dishonesty could reasonably be inferred. In the other, the court overturned the dismissal because the employer could not prove the employee had any knowledge of the irregularity.

In South Africa, calling someone a contractor does not necessarily make them one in the eyes of the law.

Courts and the Commission for Conciliation, Mediation and Arbitration look at the real nature of the working relationship — not just the label on the agreement. If the worker is economically dependent on your business, subject to your control, and integrated into your operations, the arrangement may be treated as employment regardless of how the contract describes it.
