Considering an uncontested divorce?

If you and your spouse have reached an agreement on the division of your estate/assets and debts, as well as issues pertaining to your children, you can proceed with your divorce on an uncontested basis.

The process is straightforward,
cost-effective, available to everyone and can be done online. It is only necessary for one spouse to attend at Court on the date of divorce.

However, the process requires both spouses to work together amicably in reaching an agreement on the terms of their divorce.

Domestic Violence:

The Domestic Violence Act (116 of 1998) came into force in 1999 with the main purpose of providing protection to victims of domestic abuse in South Africa.

Domestic violence is an on-going pattern of controlling or abusive behaviour that occurs in the context of a social/domestic relationship between the victim and perpetrator. The conduct of the perpetrator must harm or cause imminent harm to the safety, health or well-being of the victim.

The various forms of domestic violence and types of domestic relationships that exist are described in the images below.

The Children’s Act provides that the best interests of the child is of paramount importance in all matters concerning the care, protection and well-being of a child.

Parents (as co-holders of parental rights and responsibilities) are expected to care for the child, maintain contact with the child, act as guardian to the child, provide financial support to the child and provide for the child’s needs. Where issues arise, the co-holders must first seek to agree on a parenting plan.

A parenting plan essentially includes aspects such as:

- where and with whom the child will live;
- contact between the child and either parent or any other person;
- the maintenance of the child; and
- the child’s schooling and religious or spiritual upbringing.

The parenting plan must comply with the best interests of the child principle.

The plan must also be in writing, signed by both parties and registered with the Family Advocate or made an order of Court once endorsed by the Family Advocate.

The parents must seek the assistance of the Family Advocate, a social worker or psychologist, or mediation through a social worker or a family law attorney when drafting a parenting plan.

If the parties are unable to agree on issues relating to their child, mediation would be the most effective way to resolve their disputes.

Once made an order of Court, the parenting plan must be strictly complied with failing which either parent may be held in contempt of Court for breach thereof.

But you’re unsure of your rights going forward?

While the process may seem daunting at first, having a good exit strategy will alleviate anxiety and empower you.

There’s a list of factors to consider in preparation of an exit plan (eg. assets, finances, duty of support, children and new living arrangements).

Collaborating with an attorney you can trust, understanding your rights and strategizing accordingly (from the get-go) is essential.
