Legislative Report Card: HB 399 — Land Use Reform 🏗️

HB 399 takes a targeted approach to Florida’s land use framework, addressing development fees, approval processes, residential compatibility, and compost facilities. The bill continues the Legislature’s broader push toward more objective standards and greater predictability in local development decisions.

Our takeaway: HB 399 may not represent one sweeping change, but its collection of targeted reforms could have a meaningful impact on how development applications are reviewed and approved across Florida.

Legislative Report Card: SB 484 — Data Centers 💻

SB 484 reflects Florida’s growing focus on how large-scale data centers fit into the state’s land use, infrastructure, and environmental framework. The bill reinforces local zoning authority while addressing utility costs and water resources tied to data center development.

Our takeaway: Florida is making room for the continued growth of the data center industry, but SB 484 makes clear that local governments retain control over land use decisions and that large-load customers should bear the infrastructure costs they create.

Legislative Report Card: HB 1329 — Impact Fees

HB 1329 raises the standard for how impact fees are adopted and increased by requiring demonstrated need, current localized data, and stronger planning justification. The bill doesn't eliminate impact fees, but it establishes greater transparency and accountability for how they are supported and implemented.

Our takeaway: Impact fees remain an important growth management tool, but local governments will need stronger data and better documentation to justify new fees and significant increases.

Terin Barbas Cremer recently attended Athena at 50: Telling Our Story, hosted by the Athena Society Inc., celebrating 50 years of leadership, connection, and empowering women across Tampa Bay. The Athena Society brings together women leaders committed to advancing equality, fostering leadership, and creating opportunities through mentorship, education, and service.

The retreat honored Athena’s incredible impact over the past five decades while looking ahead to the work still to come and Bemetra Simmons’ plans for the year as President. The weekend featured inspiring conversations on storytelling, leadership, and advocacy, along with presentations from Representative Anna V. Eskamani, Latinas, Inc. and the Orlando Magic.

We’re grateful for the opportunity to reconnect with inspiring leaders, celebrate this milestone, and be part of a network dedicated to lifting others up. ✨

City of Tampa Unanimously Approves Transformative Army & Navy Redevelopment! 🎉

The redevelopment of the historic Army & Navy Surplus site is officially moving forward, paving the way for one of the largest mixed-income developments in Downtown Tampa. The project will bring approximately 1,150 residential units, with 70% dedicated to affordable and workforce housing, along with retail, public spaces, and improved connectivity throughout North Downtown. This transformative investment will help address Tampa's growing housing needs while creating lasting opportunities for the community.

At Barbas Cremer, we are proud to have served as land use counsel, helping guide the project through the entitlement process and working alongside an exceptional team.

We had a great time at the Florida Environmental Network, Inc.'s 40th Annual Florida Environmental Summer School! Jake Cremer joined Dan Delisi, Alan Krischer, Darrin Taylor and Commissioner Sean Parks to present "Planning the Future: State Leadership or State Preemption? Legislative Updates & Legal Battles," exploring some of the most significant issues shaping Florida's land use landscape.

Key takeaways included:
✔️ The defining story in Florida growth management continues to be the tension between state preemption and local control.
✔️ The Live Local Act remains at the center of that conversation, with additional legislative changes on the horizon.
✔️ The 2027 Legislative Session is expected to set the stage for a broader discussion about rewriting Chapter 163.

It was a fantastic opportunity to reconnect with colleagues, exchange ideas, and stay ahead of emerging legal and policy trends. And, of course, spend a little time enjoying the beautiful Marco Island beaches. 🏖️
