Missouri Legislative Update: Divorce & Pregnancy
Did you know? In Missouri, courts often cannot finalize a divorce if one spouse is pregnant.

A bill currently moving through the Missouri legislature aims to clarify this issue.

House Bill 243 recently passed the Missouri House unanimously and is now being considered by the Missouri Senate. If approved, the bill would make it clear that a court may enter a judgment of divorce or legal separation even if a spouse is pregnant.

Under current Missouri law, some judges interpret existing statutes to mean a divorce cannot be finalized during pregnancy. As a result, cases may be delayed until after a child is born, even when both parties agree or when waiting creates practical or safety concerns.

HB 243 would remove pregnancy as a barrier to finalizing a divorce. The bill has passed a Senate committee and is currently awaiting action by the full Senate. The bill has broad bi-partisan support and Governor Kehoe has publicly supported the measure.
