I have had several recent examples involving not only my current immigration clients, but also people with immigration cases who were told they had a court hearing months from now or even years from now, only to have their court date suddenly changed to a much sooner date
In cases involving people who are not yet my clients, they missed the new hearing date and received a removal orderbecause they didn't think to check on their case since the court date is so far away
Can you file a Motion to Reopen with the Immigration Judge and explain that you did not receive notice of the new hearing date and believed you had a different court date? Yes, potentially, however, the current filing fee for a Motion to Reopen is $1,065. If you cannot prepare and file the motion yourself and need to hire an attorney, you will also have to pay attorney's fees on top of the filing fee. If you do not file a motion within the applicable time period, you may lose the opportunity to reopen your case and could ultimately face removal from the United States if you are ever caught by ICE
I know this is frustrating, especially when you genuinely believed you had a different hearing date. The reality is that you are responsible for knowing your immigration court date, even when the court changes it. Please do not assume that the hearing date you were originally given is still your hearing date. Check your case regularly and make sure your hearing date has not been changed to an earlier date. This is just one of many tactics designed to make people give up and leave the United States or to force you to leave if you cannot keep up with ongoing litigation expenses
