Christmas Break begins today for South Bend Community School Corporation students! Let's use their break calendar for an example of how to utilize the Indiana Parenting Time Guidelines for this holiday:
This year, the custodial parent shall have the first half of the Christmas vacation, and the noncustodial parent shall have the second half of the Christmas vacation.
To determine the split of the halves, you count how many overnights are from the day your child gets out of school, until the night prior to them returning to school.
If your split of the break does not include Christmas Day, you still have time with the child/children on Christmas Day from noon until 9:00PM.
Using the South Bend Community School Corporation calendar for this year, the spilt would be as follows, given that there are 18 overnights from the last day of school (Dec. 19) until the day prior to school starting back up (Jan. 5, each parent shall have nine (9) overnights on break:
Custodial parentās half begins on Thursday, December 19, 2024, at 6:00PM, and goes through December 28, 2024, at 6:00PM. Non-custodial parent has time with child/children on Christmas Day from noon until 9PM.
Non-custodial parentās half begins on Saturday, December 28, 2024, at 6:00PM, and goes through Sunday, January 5, 2025, at 6:00PM.
Keep in mind that this schedule overrides the regular parenting time schedule, and that the Guidelines do not count New Years Eve and New Years Day as separate holidays.
If your child is three (3) years or older, but not yet enrolled in an academic childcare program or educational facility, then the district school calendar or the district where the child primarily resides shall control for the purpose of determining holiday parenting time. If you share parenting time equally, then you will use the district school calendar of the parent paying controlled expenses to determine holiday parenting time.
If you have children under the age of 3, it is slightly different, as the non-custodial parent receives a certain block of time with the child/children on Christmas Day only (in addition to their regularly scheduled parenting time):
Ā· Birth to age 4 months: two hours
Ā· Age 5 months through age 9 months: three hours
Ā· Age 10 months through Age 12 months: eight hours
Ā· Age 13 months through age 18 months: eight hours
Ā· Age 19 months through 36 months: ten hours
**the time frame is not specified, except the child is to be returned home one hour before bedtime.
Last thing: if your childās birthday, or a parentās birthday falls within the Christmas vacation, the Christmas vacation schedule takes precedence.
