They’re framed as misrepresentation, negligence, or consumer protection issues—but if the claim “relates to” an ERISA plan, preemption may still apply.

For service providers—insurers, consultants, recordkeepers, and tech platforms—that can mean early dismissal and a major shift in litigation strategy.

Bottom line: changing the label doesn’t change the law.
