They’re framed as misrepresentation, negligence, or consumer protection issues—but if the claim “relates to” an ERISA plan, preemption may still apply.

For service providers—insurers, consultants, recordkeepers, and tech platforms—that can mean early dismissal and a major shift in litigation strategy.

Bottom line: changing the label doesn’t change the law.

Yesterday, Lasher joined 500+ members of Seattle’s legal community at the King County Bar “Breakfast with Champions”—all in support of minority law scholarships and pro bono initiatives that expand access to justice.
