Dudensing Law secured a $3 million recovery for the family of a man who died after becoming septic from a “large and obvious" facial infection that a California skilled nursing facility failed to document or address. Despite his loved one repeatedly warning staff about his fall risk, he suffered at least 10 falls, including one incident in which he was found unattended outside in 100-degree heat, bleeding.

Dudensing Law is excited to welcome Summer Clerk Liza Emesibe, back for her second summer with the firm. Liza clerked with us last year and now returns as a rising 3L at UC Davis School of Law.

During her first summer, Liza worked closely with our attorneys gaining experience in legal research, drafting motions and memoranda, discovery, deposition preparation, and trial strategy. Her familiarity with our work and deepened understanding of elder abuse and neglect litigation makes Liza a valuable member of the team.

NCAA verdict and the first "enhanced autopilot" trial against Tesla. Dudensing Law Founder, Ed Dudensing took the mic to break down the firm’s record $110 million verdict on behalf of Mildred Hernandez and her family, resulting in the largest elder abuse verdict in California history.

Ed walks through how the trial team traced accountability through holding companies to hold the facility's corporate owners, Colony Capital, the publicly traded Real Estate Investment Trust (REIT), and Formation Capital, the private equity investment firm, directly responsible. They also discussed why growing private equity and REIT ownership in long-term care raises serious concerns for resident safety.

Dudensing Law recently secured a $2 million recovery for the family of a 78-year-old man who died after alleged systemic neglect at a Sacramento care facility.

Admitted for supervision after a hip fracture, the man suffered repeated falls, unmonitored weight loss, an ignored flu vaccine order, and an untreated infection before dying from Influenza A. The facility was aware of the areas in which our client was at high risk but failed to provide the support, supervision, or care plan necessary to keep him safe.

When facilities put profit over people, we will fight for accountability.

In his 2025 Rutter Group treatise “Elder Abuse Litigation,” Founder Ed Dudensing highlights what many advocates call the "Golden Rule" of elder care.

Under federal regulations, every nursing home resident is legally entitled to the highest quality of care that enables them to attain or maintain their highest practicable physical, mental, and psychosocial well-being.

Ed emphasizes that if a facility fails to provide the necessary services to meet this standard, it is a direct regulatory violation.

ICYMI: Our Founder Ed Dudensing, was interviewed by Hunterbrook as part of a major investigation into The Ensign Group, the largest operator of skilled nursing facilities in the United States.

Hunterbrook examined millions of Centers for Medicare & Medicaid Services (CMS) datapoints and thousands of pages of documents, finding that Ensign facilities failed to meet minimum state staffing requirements in California, Washington, Tennessee, and Kansas on more than 18,000 cumulative days between 2020 and 2025.

This summer we welcomed Gavin Bowen as one of our four summer clerks.

Gavin is a rising 3L at UC Berkeley School of Law, where he competes on the Alternative Dispute Resolution team and served as an article's editor for the Berkeley Journal of Criminal Law. He also led the Animal Law and Advocacy Project at Berkeley.

Gavin graduated with a degree in psychology and arrived at plaintiff-side litigation as the place where advocacy and integrity align.
