In North Carolina, you must be separated for one full year before you can file for an absolute divorce, but that doesn’t mean you have to sit around and wait.

During this separation period, you can work on property division, custody agreements, alimony arrangements, and more.

To qualify as a legal separation in NC, you and your spouse must:
- Live at different mailing addresses
- And have the intent for the separation to be permanent
