The caller surprised me with her question; "We were only together for the wedding night; can we get the marriage annulled?" The question comes in several versions including "We never slept together; how do we get an annulment?" I have had dozens of these calls over the years.

In North Carolina annulments are fairly rare, and the amount of s*x and the length of the marriage do not qualify as justification for an annulment. Most commonly, people that receive an annulment obtain the annulment because of a finding of impotence or the discovery of an unknown prior marriage (without a divorce). There are a few other grounds for an annulment and you should talk about your specific facts with a North Carolina attorney.

He said Beyoncé’s music sounds like “satanic chants.” He’s no less inflammatory offline, where he has called homos*xuality “filth” and endorsed corporal punishment for children.

The above is from the ATLANTIC Magazine article exposing the extremist and anti-semitic attitudes of our candidate for Governor. Sadly, far too many NC voters will vote for this man as a result of his anti-Semitism and expremist approach.

At the Wake County Justice Center rear entrance they continue to fly a tattered Stars and Stripes and, as always, they failed to understand how to fly a flag at half staff. How many county executives drive by or walk by this shameful display? Those that they are honoring today deserve a proper display.

SCOTUS heard arguments today regarding establishing a standard for evaluating the deference that employers must give to an employee's request for accommodation of their religious convictions. The government seeks to maintain the current standard. The Plaintiffs' seemed to get sympathy from Justice Thomas among others. Our founding father's recognized the danger posed by religion.. Sadly, many on the right wing of the GOP would be happy to see this nation become a theocracy.

Recently a court in Oklahoma was faced with the custody rights of a non-gestational spouse in a same s*x marriage. The Court ruled that the non-gestational spouse had no custodial rights because they failed to adopt the child or take other action to formalize her parental rights. (She was married to the gestational spouse but since there was a third party source of s***m the Court found that the spouse that had been the acting parent had No Custodial Rights). Note to others in the same situation: consider adopting the child born to your marriage if you are in this situation!

We once had a client obtain a domestic violence restraining order. The paper did not save the client's life. Her life was saved by following advice to stay away from her house. If she had returned home she would have been killed! A retraining order is a piece of paper, if you get such an order you still need to exercise common sense and protect yourself!

E-signatures have made it easier to sign contracts. Unfortunately, with this change it has become more common for readers to skip to the end of the contract and hit "sign here". Remember that your time spent reviewing the contract should be directly related to your financial exposure. When you sign a long term lease check what it will cost you if you need to get out and when you sign a house purchase you need to check out what it will cost if you need to back out of the house purchase. Unless your agent is an attorney he or she is not qualified to review the proposed contract on your behalf. Your spending hundreds of dollars for a house so hire an attorney for his or her advice. When you sign most builder contracts you need to know that these are usually very one sided and designed to maximize the builder's profit. If your using the builder's attorney that attorney will not be able to give you an advice as to protecting your interests!
