We had a big win in court today.

I have been arguing for years to hold the government to their burden of proof when submitting police reports and similar documents in removal proceedings. The case law has been in our favor, but the judges have consistently ignored it... until today.

We were blessed to have an immigration judge who applies the law equally to both sides, and our client's case was terminated due to the government's failure to produce the necessary evidence to sustain their charges.

Our client will get to retain their lawful permanent resident status and remain with their family here in the US. We couldn't be more thrilled. đŸ„‚

Today is the first day that applications can be submitted to USCIS for the new "Keeping Families Together" immigration program, which allows certain undocumented immigrants to apply for legal status in the U.S.

We strongly urge anyone who is eligible to apply immediately as there will likely be lawsuits filed very soon, which will shut down the program indefinitely. When this has happened in the past (e.g. DACA), those who applied before the court issued an injunction to stop the process were still able to get legal status through the program.

This is big news for many immigrants. Today, the Biden Administration announced their plan for a new executive action which will provide new protections for those currently in the U.S. without documentation. Here are the key takeaways:

"This action will protect approximately half a million spouses of U.S. citizens, and approximately 50,000 noncitizen children under the age of 21 whose parent is married to a U.S. citizen."

"Today’s announcement will allow individuals,
including DACA recipients and other Dreamers, who have earned a degree at an accredited U.S. institution of higher education in the United States, and who have received an offer of employment from a U.S. employer in a field related to their degree, to more quickly receive work visas."

We will keep an eye on this executive action so that we can assist anyone eligible to apply. Please keep in mind, however, that it may take some time to implement and it will almost certainly be subject to law suits by Republicans, which may delay implementation further.

I got a sad call the other day from a young mother who hired a document preparer to do her visa application. The preparer filed the forms and sent the young mother to a visa interview in Mexico despite the fact that the young mother was legally barred from reentry to the U.S. based on facts she had disclosed to the preparer.

Unfortunately, she is now stuck outside the U.S., separated from her family, and has no means of legally returning for the next 10 years.

Her story is all too common, and the worst part is that it was avoidable. We would never have sent her to an interview in Mexico given the circumstances, because we would have known (and told her) that she would not be able to return.

Immigration attorneys may be more expensive than document preparers, but there is a reason for that difference - the years we spend studying and mastering the law, and the accountability we face if we are wrong.

And the extra expense for the attorney is minimal compared to the potential consequences of poor representation (in this case 10 years of exile). That's not to say that there are not decent document preparers, but you take a risk when you hire someone who is unlicensed and uninsured.

For the last 3 years I have been fighting with the consulate in Mexico over the issuance of an approved U Visa for one of my clients. After countless interviews and never-ending requests for supplemental evidence, she finally got received her U Visa today and will be on her way to the U.S. soon! It was an insane nightmare, but one that finally has a happy ending.

Just to put this in context with the current discussion on immigration going on in this country, imagine if you had to wait 3 years to get your driver's license after you already passed the test and were approved. How many of you would just drive anyway and not wait the 3 years?

Some immigrants have to wait more than 20 years to get their approved visas (no joke). Would you wait 20 years to drive a car after you passed your test because the government said they couldn't give you your license yet? Of course not, you'd all drive anyway because our public transportation is terrible and you need to get places.

And that's why people cross the border illegally. To be clear, my client did not cross illegally, she waited patiently. But our legal immigration is such a mess that it drives people to migrate illegally. Anyway, we're thrilled for our client and can't wait to see her here in the U.S.!

Immigration Law Myth Busters:
Episode 2 - "Sanctuary Cities" Aren't What you Think They Are

For the second post in my series debunking myths about U.S. immigration law, we turn to "sanctuary cities." Yes, they are a real thing, but no they are not what most people seem to think they are. The term "sanctuary cities" implies that these cities are offering refuge (or sanctuary) to undocumented immigrants, which leads people to assume that they are protecting undocumented immigrants from federal law enforcement and deportation. This is a complete falsehood. None of the so-called "sanctuary cities" are protecting anyone from immigration law enforcement.

In fact, the term "sanctuary cities" simply refers to municipalities that have opted not to use their local law enforcement resources to pursue the enforcement of federal immigration law. In other words, they leave immigration law enforcement to the federal agency with jurisdiction over that are of law, Immigration and Customs Enforcement (ICE), and instead task their city officers with enforcing state and local laws, like they are supposed to.

Local law enforcement in "sanctuary cities" don't impede ICE officers from doing their job in any way, and they still cooperate with ICE in their investigations and operations where appropriate. Immigrants still get arrested and deported by ICE in these cities every day. The only difference is that the local police in "sanctuary cities" don't do ICE's job for them by hunting down undocumented immigrants on their behalf. These cities are not ignoring or obstructing the law, they are simply abiding by traditional legal jurisdictional boundaries.

To better understand this, simply imagine that a city ordered the local police to start enforcing federal tax laws tomorrow. If cities started sending local law enforcement to people's doors to conduct federal tax audits and arrest anyone who was not in compliance, you would have "sanctuary cities" popping up across America overnight where municipalities refuse to use their local law enforcement resources to enforce the federal tax code on their constituents.

In fact, the people who are most upset by the concept of "sanctuary cities" for immigrants would be the first ones setting up "sanctuary cities" for tax evaders if local police started auditing and arresting people for violations of federal tax law. The legal basis for both is the same, which is rooted in our historical separation of state and federal authority in the U.S. (Federalism). So if someone supports Federalism (and doesn't want their local police arresting their neighbors for violations of the federal tax code), then they necessarily support the concept of "sanctuary cities," at least from a legal standpoint.
