One common myth is that estate planning is something to think about later in life. But life is unpredictable. Adults of any age can benefit from having important documents in place, including a will, powers of attorney, and healthcare directives. Planning ahead is not about expecting the worst. It is about protecting yourself and the people you love.

Depending on how the Healthcare Directive is drafted, it may include instructions for how your agent should handle your medical affairs if you become incapacitated and unable to make your own healthcare decisions.

Some directives also include a HIPAA Authorization, which gives your agent the legal authority to access your medical information when needed.

Many people put off estate planning because they assume it’s only for the wealthy. That is not true. If you own anything you consider valuable, you already have an estate.

Your estate can include things like a home, a car, bank accounts, family heirlooms, personal belongings, fi****ms, high quality cookware, musical instruments, electronics, intellectual property, digital assets, and more.

Estate planning ensures that these assets are protected and ultimately go to the people or organizations you choose. It’s about clarity, control, and peace of mind—not about how much money you have.

Many people assume their family will simply “figure it out” when the time comes.

But without a clear plan, loved ones may be left dealing with confusion, conflict, delays, and unnecessary court involvement during an already painful time.

A thoughtful estate plan gives your family direction when they need it most.

In some states, once a person turns 18, they are legally considered an adult. But please know that the age of majority may be different in your state. So confirm. However, regardless, when you reach the age of majority, your medical information is protected from disclosure, even from parents, guardians, siblings, spouses, adult children, teachers, or coaches.

A HIPAA Authorization helps make clear who is allowed to receive medical information if support is needed.

A Healthcare Directive is an important legal instrument, but not all documents are created the same.

Not all lawyers draft documents similarly. And if you do not have a lawyer preparing your documents, an important component may be omitted.

HIPAA was created to protect patient privacy and make sure medical information is handled with confidentiality and respect.

But without proper authorization, even the people closest to you may not be able to receive medical updates or speak with your doctors in an emergency.

A HIPAA Authorization is especially important when it is part of a comprehensive estate plan.

Your Will, Trust, Healthcare Directive, Power of Attorney, and HIPAA Authorization should work together so your wishes are clear and the right people are empowered to act.

Not all documents stand alone well. Coordination matters.

Many people tell themselves, “That won’t happen to me.” But no one knows how illness, injury, or incapacity may affect them. Part of responsible planning is making sure someone can step into your shoes and make healthcare decisions for you if you cannot make them yourself.

The person you choose as your healthcare agent may be given significant responsibility.

Depending on how your Healthcare Directive is written, your agent may have the power to consent to treatment, refuse medical treatment, hire or fire healthcare aides, and access your private medical information.
