Another early morning at USCIS Orlando!

We wrapped up a marriage-based immigration interview for clients whose removal proceedings are currently administratively closed.

With the I-130 approval anticipated, the next step is to return to immigration court and seek to reopen the proceedings, with the goal of termination.

Depending on the judge’s decision and the circumstances of the case, adjustment of status may proceed through USCIS or immigration court.

Another marriage-based green card interview completed at USCIS Orlando!

Our client is currently in removal proceedings, but there’s an important legal distinction: because he is classified as an arriving alien, USCIS generally retains jurisdiction over his adjustment of status application.

It’s details like these that can make a significant difference in an immigration case.

The Department of Justice is increasing its focus on potential naturalization fraud, raising questions about when the government can reopen citizenship cases.
U.S. citizenship obtained through naturalization can be challenged if the government establishes qualifying fraud, material misrepresentation, or other legal grounds for denaturalization.

A federal judge has temporarily blocked a DHS policy affecting detained immigrants.

The policy had stopped biometric collection for certain individuals in immigration detention, potentially preventing pending USCIS applications from moving forward.

The court’s order requires DHS to resume biometric collection for affected individuals while the legal proceedings continue.
For those facing deportation, completing biometrics can be an important step toward resolving a pending immigration application.
