Applying for your green card? Two important changes could affect your case.

First, starting September 18, USCIS will only accept the new edition of Form I 485, Application to Register Permanent Residence or Adjust Status. Filing the wrong edition could result in your application being rejected and returned.

For applicants relying on maintaining lawful status, timing can be especially important. A rejection after your underlying status expires could create serious complications.

Second, public charge considerations are receiving renewed attention. USCIS may consider a range of factors when evaluating whether the public charge ground of inadmissibility applies, so applicants should understand how the requirements affect their individual circumstances.

Immigration forms and policies are changing quickly. Having an attorney who stays current with these changes can help prevent a technical filing issue from becoming a much larger problem.

USCIS can look back at your entire immigration history.

Something you wrote on a visa application years ago can become relevant again when you apply for a green card, naturalization, or another immigration benefit.

Prior visa applications, employment history, organizations, previous refusals, and other information may be compared against what you submit today. Inconsistencies can create questions and potentially complicate your case.

That’s why it’s important to keep copies of every immigration document you file, starting with your very first visa application.

If you no longer have your records, a FOIA request may help you obtain documents maintained by certain government agencies so you and your attorney can review your history rather than relying on memory.

USCIS checking credit scores now? 👀

A new version of Form I 864, Affidavit of Support, is now in effect, and it includes new language regarding credit reporting.

Sponsors should pay close attention. If you have a security freeze or hold on your credit report that prevents it from being accessed, it could potentially create delays in your immigration case.

The new I 864 also means that if you recently completed the previous version but have not filed yet, you should make sure you are using the correct current edition.

These changes can affect both adjustment of status and consular processing cases.

Immigration requirements are changing quickly. Having an attorney who stays on top of new forms, policies, and procedures can be critical because even a seemingly small change can affect how your case is processed.

Important USCIS deadline: September 15.

USCIS is changing versions of Form I 765 for work authorization and Form I 539 for certain extensions or changes of status.

The timing matters.

If you file using the wrong edition of the form, USCIS may reject your filing. For someone relying on an I 539 to maintain or change status, a rejection at the wrong time could create serious immigration consequences.

Do not assume that using the newest form early is safer either. Pay close attention to which edition USCIS accepts and when it becomes effective.

Before filing, double check the form edition, filing date, signatures, fees, and supporting documents.

A simple technical mistake can have major consequences.
