Just because two people are charged in the same case does not mean they should be tried together.

Sometimes a joint trial can hurt your chance at a fair outcome, especially if one person’s actions or statements could unfairly influence how a jury sees the other.

In those situations, we can ask the court to separate the cases so each person is judged on their own facts, not someone else’s decisions or mistakes.

If being tried together could prejudice your defense, severance may be an important strategy to consider.

Your client deserves to stand on their own, not be judged by someone else’s mistakes.

There are times we ask the court to separate co-defendants because keeping the cases together could be unfair.

One example: a co-defendant gave a statement or confession that implicates you. That can create serious problems for your defense.

Another: the defenses directly conflict. If one person is blaming the other and both defenses are pointing in opposite directions, a joint trial may not allow either side a fair outcome.

Sometimes severance is about protecting the integrity of the defense itself.

If you’re facing charges with a co-defendant, understand whether severance may be an option.

Being tried with a co-defendant can sometimes hurt your defense.

If you’re charged in the same case as someone else, that does not always mean you should be tried together. In some cases, we can file a motion to sever parties, asking the court to split the cases apart for the rest of the process.

Why does this matter? Because trying both defendants together can sometimes create unfair prejudice, confusion, or strategic harm to one person’s defense.

A joint case is not always the right case.
