Hearing of the Week:

A 49 year old individual who claims they are unable to work due to chronic back pain. They testified that they are unable to walk, must lay down most of the day, cannot lift more than 10lbs at a time and cannot perform household chores, cannot cook, cannot do laundry, and cannot lift groceries. Sounds good right? The question now becomes, where is the evidence? Although the claimant has health insurance, they haven't sought out any treatment for back problems since 2021, and only takes over the counter pain meds like Aleve and Tylenol. Nor do they need an assistive device, such as a cane or a walker, to support the claim that they are unable to walk.

When submitting an application for disability benefits, providing evidence is key! Regular, ongoing treatment is a MUST in order to prove what you claim is disabling. An Administrative Law Judge cannot accept your testimony as the only proof that you are disabled.

Comical testimony of the week:

ALJ: Is it true that you have chronic headaches?

Claimant: Yes

ALJ: What makes your headaches worse?

Claimant: I'm really not sure, sometimes it could be the weather or if its a full moon my headaches worsen.

Me: Huh? This is a first for me 🤣🤣

I was so intrigued by the claimant's answer that I googled it and low and behold, some individuals who suffer with chronic headaches believe that a full moon can worsen their symptoms due to the change in their sleep patterns that a full moon might cause. 🤔

Did you know.....

That most individuals that apply for Social Security Disability Benefits are initially denied. It's simply because not enough evidence regarding their disability was collected and submitted to the Social Security Administration. Once a claimant is denied SSA allows each person to appeal their claim within 60 days allowing for another opportunity to prove their disability. The SSA has (4) levels of appeal: (1)the Reconsideration, (2) an Administrative Law Judge Hearing, (3) Appeals Council and (4) the Federal Court Review. The more evidence, the better.
