Attorneys Michael Levine and Gary Fox are representing the parents of Ryan Costello, a 23-year-old minor league baseball player who died from Wolff-Parkinson-White Syndrome. According to the lawsuit, his cardiac condition was identified by the Minnesota Twins' team physician during a spring training clearance evaluation, but it was never disclosed to Ryan, and he was never referred for care.
Our team has now secured a second appellate victory in the matter, allowing the case to move forward toward trial. As Attorney Levine argued, "The overwhelming issue here is when a doctor comes to this state, commits malpractice in this state on a Florida resident, Florida law applies."
"This is a doctor who came down here as part of his work, performed 40 pre-clearance evaluations, one of which was on Ryan Costello, committed malpractice here in Florida, the only place their relationship existed, and now he is trying to escape liability by imposing another state statute."
