Florida follows intestate succession, which is the state’s default plan.

• Married with no kids? Your spouse gets everything.
• Married with kids from your current marriage? Same.
• Married with kids from a previous relationship? Your spouse gets half and your children get half.
• Not married? Assets generally pass to children, then parents, then siblings.

Many people are surprised that the law does not account for stepchildren, unmarried partners, or personal intentions.

If your plan was signed more than five years ago, there is a good chance something in it is out of date. New grandchildren, divorces, real estate purchases, retirement account changes, or updated Florida laws can all affect whether your plan still does what you intended.
