A family vacation should be filled with good memories, not a serious injury.

Our client was vacationing with his family and swimming with his young daughter in a hotel pool when his foot was cut by a broken pool grate. The incident caused a significant foot injury and nerve damage.

You booked the shore excursion through the cruise line.

You paid the cruise line.

You met your tour group on the ship.

Then you’re injured during the excursion.

Can you sue the cruise line?

Maybe. Cruise excursion injury cases can be complicated.

Many excursions are operated by independent local companies. Cruise lines often rely on that relationship to argue they are not responsible for the operator’s negligence.

But that may not end the analysis.

Depending on the facts, key questions may include:

• Did the cruise line know about a dangerous condition and fail to warn passengers?
• Was the excursion operator negligently selected or retained?
• Did the cruise line present the operator in a way that could support an agency relationship?
• Who actually operated and controlled the excursion?

Then there’s jurisdiction.

The accident may happen in Mexico, the Bahamas, Jamaica or another country. The excursion company may be based overseas. Meanwhile, your cruise ticket may require claims against the cruise line to be filed in a specific court.

That can mean multiple potential defendants, different contracts and complicated questions about where—and under what law—you can bring a claim.

A tragic ending to what was supposed to be a family celebration.

Thomas Gigler, a 56-year-old father of three, went overboard from the Carnival Panorama while returning from Mexico to California. He was traveling with his wife and family while celebrating their wedding anniversary. Despite an extensive search, he has not been found.

The tragedy also raises an important issue about man overboard technology.

Federal law addresses technology capable of capturing images of, or detecting, passengers who go overboard. Modern systems can use cameras, thermal imaging and other sensors to alert the bridge when someone enters the water.

Reviewing surveillance footage afterward can tell us what happened. Detecting someone in real time can help start a search sooner.

Nothing publicly reported establishes that Carnival did anything wrong or that different technology would have changed the outcome.

But when someone goes overboard at sea, every minute matters.

Seven people were reportedly injured following a serious collision involving a Sarasota County Breeze bus in Wellen Park.

According to authorities, the bus collided with another vehicle before striking the State College of Florida monument sign. Our thoughts are with everyone affected by this crash.
