We’re proud to welcome Ernesto Rivero to our team of trial lawyers at The Gutierrez Firm.

Ernesto represents individuals and families across South Florida who’ve suffered injuries or losses due to negligence — including slip and fall accidents, negligent security, motor vehicle crashes, wrongful death, and catastrophic injury cases.

Before joining our firm, Ernesto worked at one of the nation’s largest plaintiff personal injury firms, gaining extensive experience handling complex cases from intake through trial. Earlier in his career, he served as a civil defense attorney at a prominent Florida defense firm — experience that now gives him an edge in anticipating defense strategies and building stronger cases for his clients.

A Miami native and proud graduate of Christopher Columbus High School, Ernesto earned his B.S. in Finance from Florida State University (Torchbearer recipient and Seminole Scholar) and his J.D., magna cm laude, from St. Thomas University School of Law.

We’re excited to have him on board, trying cases and seeing the impact he’ll make for our clients and our community.

The Gutierrez Firm’s Jorge P. Gutierrez Jr. has settled a slip & fall accident case against a Miami Beach Condominium Association for $1,000,000. The victim, a 49-year-old, employed as a meat market butcher, slipped in a condo parking lot that pooled water when it rained and was in disrepair. He ended up having a fracture of the lower leg/ankle. He underwent a series of pain management injections, and physical therapy for back injuries before undergoing arthroscopic surgery to the ankle. Medical expenses were approximately $150,000.

This case was referred to The Gutierrez Firm to serve as trial counsel after an initial offer of zero. This is the firm's second 7 figure policy limits slip/trip fall settlement involving a Miami Beach Condominium in the last 6 months. Both resolved because of a pending trial.

Due to changes in case management policy and directives from the Florida Supreme Court, personal injury lawyers that do not litigate and try cases will be at a huge disadvantage come January. We on the other hand have always taken every case with the intention of taking the matter to trial, unless a significant offer resulting in a just resolution is obtained by the Firm.

We’re thrilled to share that we’ve successfully secured a $550,000 settlement for a 50-year-old waitress from California who suffered a serious ankle injury after tripping over a balcony threshold at a Miami Beach hotel while on vacation.

Initially facing complete rejection on liability from the hotel’s insurance, we stepped in and turned the case around. This settlement not only recognizes the injury she endured but also serves as a reminder that no one should face such challenges alone.

Took over a case today already in suit. Prior lawyer was a well known young instagram lawyer who basically did nothing for the last 16 months in a very significant case against a huge company. She doesn’t litigate or try cases. She took no depositions, propounded zero discovery, and hired zero experts etc. Worse than that, lawyer was hounding client to take an awful settlement barely in the 6 figures. Client now is almost 3 years in and nowhere closer to getting case where it needs to be. Hiring the right lawyer at beginning is the most important thing you can do!! Looking forward to turning on the jets and getting this one going to trial.
