For those following my case ⚖️ against Insurance Company on behalf of my client Pablo Langesfeld, WE WON!! Thursday we got a Final Judgment in his favor stating Oscar Health must cover the Prescription for treatment of his stage 4 pancreatic cancer! We are so grateful to the jurors and Judge 👩‍⚖️ Migna Sanchez-Llorens for their time and consideration to this case! Justice has been served. ⚖️

Today we had an amazing victory against Oscar Insurance Company who continues to deny a prescription to our client who suffers from stage 4 pancreatic cancer. The jury awarded a verdict answering yes to 4 of 5 questions. Next week we will finalize arguments with the judge as to interpretation of the policy. We are confident the Judge will make the right decision. 👨‍⚖️👩‍⚖️⚖️💙

The Lawsuit Process: From Engagement Letter to Filing

Once a client agrees to sue, we formalize the attorney-client relationship through an engagement letter. Depending on the case, it could be contingency or hourly. Then we draft the complaint, prepare supporting documents, and file it in court along with a summons to notify the insurer. This starts the litigation process.

How Long Do These Cases Take? Depends on the Insurer

These lawsuits can last from 3 months to 2 years, and much of that depends on the insurance company. If they decide to fight, they’ll drag the case out—even spending more on lawyers than the treatment would have cost. Many of them have no compassion for what patients are going through.

What Is Bad Faith by an Insurance Company?

In Florida, insurers can be held accountable for acting in bad faith—meaning they denied coverage without a valid reason or acted unfairly. If proven, patients can recover more than just the cost of treatment. They may be entitled to additional damages, including emotional distress or long-term harm caused by the delay.
