Errors in capital cases are costly. Oklahoma needs independent oversight | Opinion — The Oklahoman

Oklahoma taxpayers, victims and residents deserve better than a capital punishment system that produces so many wrongful convictions.

In its last term, the United States Supreme Court reviewed two death penalty cases: Richard Glossip and Brenda Andrew. Both were from Oklahoma County. Both were tried in 2004 and both involved prosecutorial misconduct and error. The current court rarely intervenes in capital cases, making the reversal of Glossip and remand of Andrew especially significant.

Errors in capital cases are costly. They harm the victims, the wrongly convicted and the system of justice itself. They also cost taxpayers millions. Glossip is costing the taxpayers $1.7 million and climbing daily.

JUDGE FAILED TO DISCLOSE PERSONAL TIES TO PROSECUTOR IN TWO DEATH ROW CASES — The Intercept

Veteran prosecutor Fern Smith convicted both Tremane Wood and Richard Glossip. She calls a judge in both cases a friend.

“IN HIS OPENING statement that morning, Knight, Glossip’s longtime attorney, made clear that the hearing was about much more than Stallings or Smith — or even Glossip himself. The case was the product of an entrenched prosecutorial culture that had never been reckoned with in Oklahoma City. “It’s not a great culture,” Knight said bluntly. “Honestly, Your Honor, it’s got a bad reputation around the country. There’s a lot of death sentences here, a lot of death sentences that were overturned here.” What they were asking for, Knight said, was a judge not steeped in this culture.”

Third judge recuses from Richard Glossip case over ties to past prosecutors — KFOR

OKLAHOMA CITY (KFOR) — A third judge has recused herself from Richard Glossip’s latest trial after defense attorneys argued she had personal ties to prosecutors accused of misconduct in Glossip’s 2004 conviction.

Glossip’s attorney, Don Knight, said recent judicial appointments have undermined the fairness of the retrial ordered earlier this year.

“You can’t have a fair trial if you don’t have a fair judge,” Knight said.
