California employers: Currently, if your company website runs analytics, pixels, or a chat tool that collects visitor data, those visitors can sue you under the California Invasion of Privacy Act ( **A).

However, that may change very soon. If becomes law by September 30th (today), only the Attorney General could bring one of the most common of these claims. Other claims would stay on the table.

California employers: if AI helps you monitor, discipline, or lay off employees, four (4) bills awaiting Governor Newsom's signature could change how you do it: SB 947, SB 951, AB 1883, and AB 1331.

For example, if SB 951 is signed, it could make employers who skip required notice owe back pay plus $500 a day in penalties. AB 1883 would ban AI tools that read employees' emotions.

The signing deadline is September 30, 2026 (in 6 days).

California's minimum wage will increase to $17.40 per hour on January 1, 2027. For most businesses, the more significant issue is what the change does to salaried staff.

California ties the exempt salary threshold to the minimum wage, so that figure rises as well. Anyone classified as exempt will need to earn at least $72,384 annually, up from $70,304. A worker paid below that threshold becomes non-exempt on January 1, meaning they are legally entitled to overtime pay, meal and rest premiums, and accurate time records.

Now is the time to identify salaried staff who fall short of the new threshold and confirm that they still meet the applicable duty requirements. Salary is only one part of what establishes an exemption.

It is also worth verifying the rate that applies where each person actually performs work, since numerous cities and counties maintain minimums above the state rate.

California employers received a clear signal about workplace privacy this month. The state's privacy regulator launched its first sectoral audit, and workforce data is squarely in scope.

The California Privacy Protection Agency will examine gig economy platforms for compliance with the Consumer Privacy Act, focusing on whether workers and consumers can actually exercise their right to know what information is collected and how it is used. The CCPA is the only comprehensive state privacy law that extends those rights to employees, applicants, and independent contractors.

California employers with remote workers in other states received important guidance from a recent decision by the Court of Appeal.

In Saberin v. Alation, Inc., the court held that the state's no-arrest-record protections did not extend to an employee who lived and worked in Utah, was arrested in Florida, and was terminated by decisionmakers in Illinois. The employer's California headquarters was not a sufficient connection, nor was the choice-of-law clause in the parties' agreement.

What mattered was where the employee worked and where the termination was directed. Had California-based personnel substantively driven that decision, the outcome could have gone the other way.

California shareholders received an important affirmation of their statutory inspection rights in a recent California Court of Appeal decision. In Salamon v. Orchid Global, the court refused to enforce a Delaware corporation’s forum-selection bylaw where doing so would have required shareholders to pursue their California statutory inspection rights in another state.

The decision has implications for corporations incorporated outside California that nevertheless maintain offices or corporate records within the state. Under the court’s ruling, an out-of-state corporation cannot rely on its bylaws to redirect a qualifying California shareholder’s inspection claim to another jurisdiction when California law provides the shareholder with a right to inspect the corporation’s records.

By extending inspection rights to certain corporations with a California presence and limiting the ability of corporate bylaws to interfere with those rights, the court confirmed that California law provides protections that cannot be avoided simply because a corporation is organized under the laws of another state.
