Does a 1031 Exchange change how property is handled in a trust?

No.

If a replacement property from a 1031 exchange ends up in a trust, it simply becomes another trust asset. The successor trustee manages it according to the trust’s terms — just like any other property.

The trustee may still be able to hold, sell, or even exchange the property again, depending on the situation.

As always, trustees should work with their CPA and attorney when making decisions involving trust-owned real estate.

With a very heavy heart, I am sad to share that the GB 1031 Exchange Family and the entire 1031 Exchange industry have lost a wonderful soul, David Blair.

For over a decade, I had the privilege of working alongside him and am honored to have called him a true professional, trusted colleague, and dear, dear friend.

The 1031 community is smaller without him.
But we are better because of him.

Please join us in remembering and honoring his life. David will be more than missed as a treasured part of our family. We are blessed to celebrate the friendship, leadership, and kindness he leaves behind.

Starting March 1, 2026, the U.S. Treasury’s Financial Crimes Enforcement Network (FinCEN) will implement a new reporting requirement for certain residential real estate transactions.

Here’s what you need to know:

If a residential property (1–4 units, condos, co-ops, or vacant land intended for residential use) is purchased without financing and the buyer is an LLC, corporation, or trust, additional reporting may be required at closing.

The goal? Increased transparency around beneficial ownership in all-cash transactions.

What about 1031 exchanges?

Most exchanges involving a Qualified Intermediary (like GB 1031) are generally exempt from this reporting requirement. Reporting responsibility will remain with the closing agents. However, transaction structure matters — especially when entities or trusts are involved.

As always, timing and planning are key.
