Big news for election transparency in Pennsylvania. Earlier this week, the Pennsylvania Supreme Court issued a unanimous decision in Honey v. Lycoming County Offices of Voter Services holding that Cast Vote Records (CVRs) are public records that must be disclosed under the Election Code. CVRs are the spreadsheet reports that capture, line by line, how every ballot was tabulated in an election. Essentially, they let the public β€œcheck the math” of the official vote count without revealing how any individual voter voted. Chadwick Schnee of Schnee Legal Services filed an amicus curiae brief in this case on behalf of Audit The Vote PA and two individual advocates for election transparency, arguing that CVRs should be publicly accessible. The Court agreed, reversing the Commonwealth Court’s 2024 decision that had shielded CVRs from disclosure entirely. There is an important caveat: the Court held that access to CVRs runs through the Election Code, not the Right-to-Know Law. That means requests must come from qualified electors of the county and be made directly to the county board of elections. A great day for open government and public trust in our elections. Schnee Legal Services is proud to share a win for free speech by Chadwick Schnee in Bradford County. The lawsuit filed by a county solicitor against our client, Walter Woods of Canton, was withdrawn Friday. Mr. Woods did nothing more than stand up at a public commissioners meeting and voice his opinion about a law firm being paid with taxpayer dollars. For that, he was sued. Cases like this are exactly why Pennsylvania's Uniform Public Expression Participation Act (UPEPA) exists. Ordinary citizens have the right to criticize their government and the people it hires, without fear of being dragged into court for it.
