Do you need a pardon AND an expungement to get your gun rights back?

Technically yes, and here’s why.

Attorney Mark Walmer explains that while a pardon is what clears the conviction legally, it is the expungement that actually removes it from your record.

Once a pardon is granted, the case is typically automatically expunged, and that is what removes the barrier from your Pennsylvania State Police record.

In simple terms: The pardon opens the door and the expungement clears the path.

Not all background checks are the same!

Attorney Mark Walmer explains the difference between FBI, Pennsylvania State Police, and PICS background checks, and why each one may show different information.

Every system uses different criteria, which is why something may show up on one check but not another.

Our office is most familiar with the Pennsylvania State Police Full Access Review, which gives a deeper look into your record but there’s more to this topic that we’ll be breaking down in a future video.

Understanding your record starts with knowing where it’s being checked.

If your charges were dismissed… can you still own a firearm? Yes!

Attorney Mark Walmer explains that a dismissed charge is a non-conviction, meaning you are still considered innocent under the law.

Because of that, dismissed charges generally cannot be used against you when it comes to firearm rights.

Knowing the difference between a conviction and a non-conviction can make all the difference when understanding your rights.

Does a domestic violence charge ban you from owning a firearm?

Attorney Mark Walmer explains how even a misdemeanor simple assault can result in the loss of firearm rights if it involves domestic violence.

He also breaks down how different assault gradings work and why these charges carry consequences far beyond fines or jail time.

When it comes to firearm rights, the details of your charge matter more than you think.

Does an expunged record show up on a firearm background check?

Nope! Once a record is expunged, it is completely removed.

Attorney Mark Walmer explains that expungement is the destruction of the record, meaning it should not appear on background checks, including those used for firearm purchases.

That said, it is important to make sure the process is fully completed and updated before taking the next step.

Knowing the difference between expungement and sealing matters more than you think.

Is it really legal to own certain weapons like a muzzleloader if you have a felony in Pennsylvania?

We recently saw a comment telling people it’s okay to own certain guns like muzzleloaders if you have a felony. Well, it's not that simple and is dangerous advice.

Attorney Mark Walmer explains how Pennsylvania law defines a “firearm” and why certain weapons can still create serious legal issues for someone with a prohibited status.

What seems like a loophole can quickly turn into new charges.

If you have a criminal record, this is not an area to guess on. Always be cautious and speak directly with an attorney before making decisions involving firearm ownership.
