Today our firm filed suit in Fayette Circuit Court on behalf of three Fayette County Public Schools paraeducators — Kim Delk, Carter Delk, and Zack Howard.

On the morning of November 17, 2025 — hours before a seven-year-old nonverbal autistic student climbed out of a classroom window and left campus through a hole in the perimeter fence — one of them warned the assistant principal, in person and in writing, that the classroom had no certified teacher. The written answer came back: "We don't have any others."

The child was recovered safe. Our clients were not treated the same way. The complaint alleges their badges were deactivated the same day they refused in writing to resign — based on a false report that they already had; that one was told a statute that does not exist required her termination; and that two were told their continued pay depended on giving up the name of their attorney.

They did the one thing every employer says it wants: they put the danger in writing before anyone was hurt. The public has heard half of this story already; we intend on telling the rest of this story in court.
