Friday we were able to secure an excellent result for our client who was seriously injured after being T-boned by a semi-truck. My client had been injured in a car accident by a negligent driver. The insurance company for the negligent driver offered $3,500 to settle her case. We filed a lawsuit on her behalf and the insurance company offered their policy limits of $25,000.

If you’re involved in a car accident it may not seem like hiring an attorney is time sensitive, but it is. In Kentucky, your Basic Reparations Benefits (BRB) also known as Personal Injury Protection, is a coverage through your own auto insurance. It pays the first $10,000 of medical bills. It is common for an ER visit to exceed that $10,000 limit.

Without an attorney there is a good chance that an ER visit will exhaust your coverage. But Kentuckians have rights. You have a right to direct your PIP benefits. If you make a written request you can tell your insurer to reserve your benefits. This allows an injured person to use their PIP benefits for treatments that aren’t always covered by their health insurance such as chiropractic treatments or massage therapy. It also allows you to put a lot more of that money in your pocket.

If you are involved in a car wreck you should NEVER agree to a recorded statement with the other driver's insurance. Their only purpose is to assign some amount of fault to you. Don't do it.

I feel like I have posted this before but it comes up again and again. You can change car insurers while your claim is being processed. Auto insurance is a type of policy called an "occurrence policy" which means that if the loss occurred during the policy period then the policy applies. If the policy is terminated or in not renewed for an additional term, that does not change your ability to make a claim on that policy.

I have been all over the state this week. Monday I had court in Jefferson Circuit Court on a car wreck.

Tuesday I had Hopkins District Court related to a wrongful death car accident. Signed up a new car accident in Crittenden County while I was in the neighborhood. Lastly I picked up the file on a 2017 Muhlenburg County trucking case.

Wednesday I had a deposition in Hazard. For my western Kentucky folks, that’s Perry County.

Yesterday I had a deposition in a fayette county car accident and workers comp case.

Today I took to Zoom for depositions in a Clark county car accident.
