Did you know that if your "non-consumer" debt is more than your "consumer" debt, that you may qualify for an exception to the Means Test and be eligible to file a chapter 7 case? Many that have high income and do not otherwise qualify can file per this exception. The most common kind of debts that are considered "Non-consumer" debts are taxes, student loans, and business debt. Total your mortgage, car loans, credit cards, medical bills, etc (consumer debt) and if your non-consumer debt total is at least 51% of your TOTAL debt, you may qualify to file based on this exception. Many don't realize they could possibly qualify for a Chapter 7 bankruptcy based on "Special Circumstance". Say you've held a high paying position but now are retiring or (hopefully not) have lost that job. Under "normal" circumstances, your high income would prevent you from being able to file a Chapter 7 bankruptcy to wipe out debt. But due to new "special" circumstances, your eligibility may have changed. There are many other things that would qualify as "Special Circumstance". Um, I just realized I forgot to post that attorney Cecily Ethridge joined our firm like - back in September?!! LOL!! Please don't tell on me (this is Joanie by the way)! But anyway!
