Back to School, Southwest Florida! 🎒📚

A new school year is here!

Albert Matthews Law would like to wish all of the students, parents, teachers, administrators, bus drivers, and school staff throughout Lee County and Collier County a safe and successful start to the 2026–2027 school year.

Tuesday, August 11 is the first day of school for students in both Lee and Collier counties.

For families who are co-parenting, the beginning of the school year is also a good time to double-check the details that can easily get overlooked:

• Teacher conferences and school events
• Holidays and school breaks

Child Custody vs. Timesharing: What Does Florida Actually Call It?

A lot of parents still use the term child custody, and honestly, that makes sense because it’s the phrase most people are familiar with.

In Florida, though, the courts usually talk about parental responsibility, parenting plans, and timesharing instead.

Parental responsibility is about who helps make important decisions for the child, such as healthcare, education, activities, and other major parts of their life.

Timesharing is the schedule that explains when the child will be with each parent. That can include regular weekdays, weekends, holidays, school breaks, vacations, transportation, and communication.

All of that is typically outlined in a parenting plan.

The goal is not just to divide time on a calendar. The goal is to create a plan that supports the child’s stability, routine, and best interests.

Every family is different, and these situations can quickly become emotional or confusing. Having a clear understanding of the terms and the process can make a big difference.

👨‍⚖️ What Is a Guardian ad Litem?

When a court case involves children, the judge’s highest priority is making decisions that are in the best interests of the child. In some situations, the court may appoint a Guardian ad Litem (GAL) to help provide additional information.

A Guardian ad Litem is an individual appointed by the court to represent the best interests of the child during legal proceedings. Their role is not to represent either parent, but to focus on the child’s well-being.

A Guardian ad Litem may:

✔️ Meet with the child and family members
✔️ Review important records and documents
✔️ Speak with teachers, counselors, or other individuals involved in the child’s life
✔️ Observe interactions when appropriate
✔️ Provide recommendations to the court regarding what they believe is in the child’s best interests

It’s important to understand that a Guardian ad Litem does not make the final decision. The judge considers the Guardian ad Litem’s findings along with all of the evidence before making a ruling.
