Public service announcement:

Resisting arrest in WV includes any actions that “forcibly or illegally hinder, obstruct or oppose”a law enforcement officer in their official duties, such as physically resisting restraint (cuffs), running away or fleeing from the officer or non physically obstructing the officer by interfering in an arrest (trying to come between the officer and suspect, walking up and inserting yourself where you don’t need to be).

Resisting is a misdemeanor under WV Code 61-5-17 and is punishable by fines and/or jail time.

Don’t resist. Don’t give the officer a reason to tack on any other charges. Stand still. Obey all lawful orders such as stepping out of the vehicle, stopping to answer questions and putting your hands behind your back. Don’t argue with the officer. Arguments are what you hire a lawyer for and they take place in court not road side or wherever you may be.
