When does silence in a prior WCAB decision become preclusion—and when does it leave issues open for future litigation?

In his latest article, MS&A attorney Sure S. Log breaks down two important recent WCAB panel decisions—Barrick v. California Department of Public Health and Melendez v. Kellermeyer Bergensons Services, LLC—that clarify how collateral estoppel applies in workers’ compensation body part claims.

The decisions reinforce a key principle: a prior findings and award that is silent as to specific body parts is not, by itself, a final decision on the merits for purposes of issue preclusion. However, the analysis becomes more nuanced when considering how findings (or the absence of findings) interact with statutory requirements under Labor Code section 5815 and continuing jurisdiction under section 5803.

🎯 Congratulations to MS&A’s Keith Figgins on securing a Take Nothing decision in a complex psychiatric injury claim!

Keith obtained a Take Nothing victory for his client by successfully asserting a good-faith personnel action defense. Less than one year after the matter was referred to the firm, Keith completed discovery and conducted multiple days of trial, resulting in a favorable decision within 13 months of referral. Through effective cross-examination and compelling HR testimony, he demonstrated that the termination was a lawful, good-faith, non-discriminatory personnel action rather than a compensable industrial injury.
