We're proud to share that a federal judge has ruled in favor of the servers and bartenders we represented in a wage-and-hour case against the operators of several Buffalo Wild Wings franchise locations.
After a three-day bench trial before Judge Algenon L. Marbley in the U.S. District Court for the Southern District of Ohio, the Court found that the restaurants violated the Fair Labor Standards Act and Ohio wage law — failing to give workers proper notice of the "tip credit" and paying them the lower tipped rate for untipped work like dishwashing, cleaning, and closing duties.
The Court awarded these workers approximately $295,000 in unpaid wages and damages.
"Workers who depend on tips are entitled to clear notice of how they're being paid and fair compensation for every hour they work," said Bob DeRose, Partner-in-Charge of our Workplace Litigation Department.
This case took nearly five years, from filing in 2021 to trial in 2026. We're grateful to our clients for their patience and courage, and proud of the trial team that saw it through.
