We're proud to share that a federal judge has ruled in favor of the servers and bartenders we represented in a wage-and-hour case against the operators of several Buffalo Wild Wings franchise locations.

After a three-day bench trial before Judge Algenon L. Marbley in the U.S. District Court for the Southern District of Ohio, the Court found that the restaurants violated the Fair Labor Standards Act and Ohio wage law — failing to give workers proper notice of the "tip credit" and paying them the lower tipped rate for untipped work like dishwashing, cleaning, and closing duties.

The Court awarded these workers approximately $295,000 in unpaid wages and damages.

"Workers who depend on tips are entitled to clear notice of how they're being paid and fair compensation for every hour they work," said Bob DeRose, Partner-in-Charge of our Workplace Litigation Department.

This case took nearly five years, from filing in 2021 to trial in 2026. We're grateful to our clients for their patience and courage, and proud of the trial team that saw it through.

The Dept. of Labor just dropped a new opinion letter (FLSA2026-5) — and your employer might try to use it against you. Here's what you ACTUALLY need to know. 👇

🏥 The setup: A salaried "exempt" nurse-specialist picks up occasional weekend hourly shifts as a staff nurse. Does that extra hourly work destroy their overtime exemption?

📌 The DOL's answer: No — BUT only if the employer is already meeting EVERY requirement of the exemption.

Here's the part employers don't want you to read 🚩

✅ Your PRIMARY DUTY must still be real exempt work ✅ Your salary must be GENUINE — not an hourly wage in a costume ✅ Picking up a shift or two ≠ losing protection… but watch the creep

⚠️ The label is NOT the job. A fancy title + a salary won't save an employer if your day-to-day reality is frontline hourly work.

⚠️ This letter changed NOTHING about the core rules. It applies decades-old law. Anyone waving it around as a license to cut your overtime is overreading it.

💡 Bottom line: If your "exempt" title doesn't match what you actually do all day — this letter doesn't legitimize that. The exemption either fits your real working life or it doesn't.
