Two bonus tips: A “premarital retirement statement” is the statement showing the balance of your retirement account right before you got married. In many states, you can carve that our as your separate property. Plus ask for the growth on that account!

If you are concerned your ex may be using your name and information to open up credit cards or other debt, you can freeze your credit! Just google “freeze credit”

I have been a divorce attorney for 13 years… and I know when I don’t have the answer my client needs.

Here are some things I am not:
-tax professional
-therapist
-mortgage specialist
-home appraiser
-business valuation expert
-pension valuator

I know enough about all of these areas to know when we need to call in an expert.

You might be thinking, why would I hire a lawyer if they can’t do all this stuff for me? Won’t that be expensive?

But picture this… would you go to your GP/regular doctor if you needed surgery? Or to have a root canal. No way. You’d get a referral.

A really good divorce lawyer will guide you through the process. In addition to handling the legal issues, they will project manage the divorce and provide excellent referrals. Judges are human. In my 13 years as a divorce lawyer, I will say, most judges are trying to do the right thing and make reasonable rulings.

But it is always a roll of the dice when you bring a parenting issue to a judge. They’re not omnipotent. They’re just people. And even when they really care they are not going to have all of the facts and context that you do.

Typically neither party is quite happy with the judge’s ruling on major parenting issues. And sometimes the courts really go off the rails.

There are times when people need to go to court. When there’s a safety issue, for example. But if there is a way that you can stay out of court and keep control over your situation rather than ceding all control to the judge, do it.

A great lawyer can help you approach your case strategically, swiftly and realistically. And can help you use tools to stay out of court like smart negotiation, planning, mediation and more.

I would pick an attorney who knows and gets along with my spouse’s attorney.

If one person finds a good divorce attorney— competent, specializes in family law, responsive, amicable and settlement focused, good reputation— ask that attorney for recommendations for the other spouse.

If both parties have good lawyers… you are miles ahead of the game. You’ll get good and realistic advice and the case will move. If the lawyers have worked together before they can fly through the case much faster. Saving you money and time.

My clients ask their spouses if they want a list of names and many of them take them up on that. And we give a list of 5 (or more) names that the spouse can look up and interview.

The financial docs you should make copies of now are: tax returns (especially last 2 years), current statement from bank, retirement, investment accounts, your spouse’s paystub. If you don’t know where these things are or don’t have access to them that’s okay, your attorney can get them for you during the divorce. But if you have them now you can share the numbers with your attorney in your consult to get a better idea of what to expect.

If any of these are missing from the consult, I would keep looking. Trust your gut and use this framework.

I would trust a referral from another lawyer or professional (financial advisor, therapist etc.) more highly than someone who does not interact with divorce attorneys a lot. But referrals from FB groups or friends are still worth calling.

You want the right communication style that works for YOU.

If you include this magic language in your parenting plan, you’re covered. Comment “magic” to get it. Make sure you’re following first so it makes it to your DMs.

Ever heard your attorney talk about the “status quo” in your divorce? Here is what that means.

If your spouse does not agree to keep doing these things (they often will after hearing from your attorney) you may be able to file a motion requesting that the court ORDER them to do it.
