A Civil Jury finds St. Paul police officer, Nathaniel Younce, liable for the wrongful death of Cordale Handy. Cordale Handy was shot and killed by St. Paul police in 2017. A lawsuit was filed by Kevin O'Connor against the officers and St. Paul Police Department. After a 6-year battle, Cordale Handy's Mother, Kimberly Handy, was awarded $11.5 million by a jury verdict. This is the largest verdict ever awarded against the St. Paul Police Department. Attorney Kevin O’Connor believes this is evidence that people can get justice in incidents involving police even when no video of the killing exists.
“Now justice can happen for those people who have been wronged, where they have been denied, saying that it didn't happen, where police come forward saying it didn't happen,” he said. “Because we uncovered the evidence that proved those lies, they were trying to do."

A federal jury has awarded the family of Cordale Handy $11.5 million after finding a St. Paul police officer used unreasonable force in his death in March 2017.

One year ago today, Malcolm James was murdered by Officers at the Racine County Jail. They rendered no medical aid after choking him to death. They proceeded to attempt a cover up while the Sheriff intentionally mislead the public and humiliated and lied to his family. Malcolm's death was the 2nd death in Racine County Jail in 2 days. This must be changed!! Today, please remember Malcolm James and pray for his family.

Congratulations to Kevin W. O'Connor for winning a unanimous decision of the Supreme Court of Illinois regarding, Javier Robinson v. The Village of Sauk, et al. 2022 IL 127236. This is a landmark decision regarding police chase cases. This decisions is regarding Section 4-106(b) of the Tort Immunity Act (745 ILCS 10/4-106(b) which provides local public entities and public employees with absolutely immunity from liability for any injury inflicted by an escaped or escaping prisoner. This case held that several police officers and their government employers did not have immunity under section4-106(b) for injuries suffered by the Plaintiff, a pedestrian hit by a fleeing vehicle during a police chase, because the person the police officers were chasing was not “an escaped or escaping prisoner” within the meaning of the Tort Immunity Act 2021 IL App(1st) 200223.

The appeal was handled and argued by Kevin O’Connor of the O’Connor Law Firm, Ltd. Timothy Lapp of Hiskes, Dillner, O’Donnell, Marovich, and Lapp, Ltd argued for the defense. Plaintiff’s brief was supported by an amicus brief from the Illinois Trial Lawyers.

This decision also overturns the Townsend v. Anderson, 2019 IL App (1st) 180771 case.

Three years ago today, Marcus McVae was shot and killed by a Texas DPS Trooper. Marcus was unarmed and no charges were brought against the Trooper. Our office filed suit in Federal Court and will continue to fight for justice for him!!!
