The insurance company denied neck surgery after an IME. We fought back and won.

In this real Illinois workers’ comp case study, a packing-plant worker needed cervical spine surgery, but the insurance company disputed causation, denied treatment, challenged TTD, and relied on an IME doctor.

McHargue & Jones took the treating surgeon’s deposition, cross-examined the IME doctor, tried the case before the IWCC, won surgery, TTD, medical bills, and back pay — then defended the win through multiple appeals.

This is why trial preparation matters. A denied surgery is not always the end of the case.

“Will my workers’ comp case go to trial?”

That is one of the most common questions injured workers ask once a case becomes disputed.

The honest answer: most Illinois workers’ comp cases do not end in a full trial. But many cases still need pressure — a hearing request, a 19(b) petition, doctor depositions, IME challenges, or serious preparation — before the insurance company finally approves treatment, restarts checks, or makes a fair offer.

Matthew Jones explains what happens when a workers’ comp case moves toward trial, whether you may have to testify, and why preparation can matter even if the case eventually settles.

Most Illinois workers’ comp cases do not go all the way to trial — but some cases need to be prepared like they will.

If your surgery was denied, your TTD checks stopped, the insurance company is relying on an IME, or the settlement offer is unfair, a hearing before the Illinois Workers’ Compensation Commission may become necessary.

We put together a full guide explaining what happens at an Illinois workers’ comp hearing or trial, including Section 19(b) hearings, doctor depositions, IME disputes, testimony, appeals, and trial vs. settlement strategy.
