Argionis Law recently settled a case where a worker fell 20 feet off of a fixed ladder while doing repairs. The individual suffered serious fractures in both legs due to the ladder not being in regulation with OSHA standards. Fortunately we were able to recover 4.2 million dollars for the client.

6 things to remember when you are in a car accident.

1. Exchange auto insurance information. Use your phone to photograph the other driver’s insurance info and driver’s license. With out this information you cannot bring the claim.

2. Take photos of the vehicles and the damage caused by the crash, both your car and their car. Often times, insurance companies dispute the points of impact on the cars. Sometime photos can be used to prove who was at fault. Take a few photos of where the crash happened.

3. Make a police report with the local police or the IL state police if it happened on a highway. Insurance companies will often refuse to open a claim without a police report.

4. If you feel pain or are hurt make sure you tell the police. Even if you feel its minor, tell the police. Pain sometimes gets worse the next day. There is a section on the police report for injuries; if you tell the officer they will note it in the report. Insurance companies often use the fact that you did not complain of pain at the scene as a basis to deny that you were hurt.

5. If you are hurt or feel a lot of pain, call for an ambulance. Your health is paramount. Get checked out.

6. DO NOT give a statement to the auto insurance company, without first talking to a lawyer or knowing your rights. Insurance companies often ask questions in a manner in which they suggest that you are at fault or that you are not hurt. You are not under any legal obligation in IL to make a statement to the insurance company. Talk to a lawyer first!

Cars have to share the road with bikes. Biking is a major form of transportation and recreation in the city of Chicago. Cars have to accept and share the road with all bicyclists. That is the law. If you are injured by a vehicle, please make sure you get all the information of the driver (name, home address, insurance information), file a police report and seek medical care. Sometimes, the driver does not stop, but a bicyclist may use their auto insurance as an underinsured claim. Seek out legal advise sooner than later, many times insurance companies take recorded statements from the injured person (you are not under any legal obligation to give a statement). They ask questions you do not expect. Please keep in mind the insurance company is looking out for the interests of the person who struck you. I have received many calls regarding whether people who contract covid19 at work are entitled to workers compensation benefits. Glad to announce that yesterday, my law partner Al Koritsaris and I obtained a $12,352,872.51 verdict for a client who suffered a crush foot injury and complex regional pain syndrome. Client's foot was run over by a forklift at Menards home improvement store. We are happy that we were able to obtain justice for our client.
