H-1B CAP SEASON IS APPROACHING - Employers Start Planning Now

H-1b cap subject registration period for FY2027 is opening soon. Employers planning to hire foreign nationals should start planning and preparing:

Important facts to know about h-1b:
1. Employer registration window is short: March 4th through 19th.
2. H-1b position must be specialty occupation: menaing the educational qualification for the job must be bachelor's or equivalent or higher
3. government specified wage level for the position must be paid

Early planning and document preparation are key to avoid last minute scrambling. Now is the right time to assess eligibility and prepare.

H1B TRAVEL BAN!!!

All h1b workers new or existing returning to the United States as h1b worker status are to pay $100000 to the Government of United States. CBP officers should be checking the payment receipts starting September 21, 2025 12.01 A.M. Presidential proclamation imposed this requirement September 19, 2025.

Restriction is on travelers. Those within the United States are not affected by this payment requirement.

Exemptions: There is a national interest exception and the no threat to national security. More clarification should be expected if it would apply to individual. employer and industry and the standard for it to better understand how to request this exemption. Department of Homeland Security would determine this exception.

H1bs employees abroad must hop on that flight today and return before midnight tonight!!
