Politics aside, bankruptcy reforms are coming. I have copy/paste a concise summary of them that A.I. generated. Property taxes will never be extinguishable by any bankruptcy filing. However, the means by which a debtor can file bankruptcy is changing. Creditors ,who included tax lien sale certificate holders and county government lien holders, may be seeing an uptick in bankruptcy filings going forward. The proposal to eliminate Ch 7 & Ch 13 filings into one single Ch 10 category sticks out !

The main bankruptcy changes in 2025 include the automatic adjustment of dollar amounts for inflation, the expiration of temporary debt limit increases from the pandemic, and several proposed legislative reforms.
Automatic inflation adjustments (April 1, 2025)
Effective April 1, 2025, many bankruptcy dollar limits were automatically adjusted upward to account for inflation, as required by law every three years. These increases affect:
Exemption amounts: The value of property debtors can protect in bankruptcy increased.
Debt limits: The thresholds for qualifying to file under certain chapters of bankruptcy, including Chapter 13 and Chapter 11, Subchapter V, were raised.
Priority claims: The maximum amounts for certain priority claims, such as employee wages, were also adjusted.
Trustee compensation: The base fee for Chapter 7 trustees in no-asset cases was doubled from $60 to $120, the first such increase in over 30 years.
Expired pandemic-era relief (June 21, 2024)
While technically a late-2024 change, the expiration of temporary bankruptcy provisions from the COVID-19 pandemic had a significant impact on 2025 filings.
Chapter 13 eligibility reverted: The temporary combined debt limit of $2.75 million for Chapter 13 expired, and the separate, lower limits for secured and unsecured debt were reinstated.
Subchapter V debt limit lowered: The temporary $7.5 million debt limit for small businesses filing under Chapter 11, Subchapter V reverted to a much lower, inflation-adjusted amount.
Proposed extensions: A bipartisan bill, the "Bankruptcy Threshold Adjustment Extension Act," was introduced to extend the higher limits for another two years, but as of mid-2024, it was still under committee review.
Proposed Consumer Bankruptcy Reform Act (CBRA) of 2025
This legislative proposal, if passed, would be one of the most significant changes to consumer bankruptcy law in decades. The bill would:
Consolidate chapters: Chapters 7 and 13 would be eliminated for individuals and replaced by a single, new Chapter 10.
Streamline process: The new chapter is intended to make filing for bankruptcy simpler and more accessible.
Simplify student loan discharge: The "undue hardship" requirement for discharging student loans would be eliminated, potentially making them easier to get rid of in bankruptcy.
Expand debtor protections: It includes more protections against collection actions and limits some powers of creditors.
Affect creditors: If enacted, the bill would likely reduce recovery for unsecured creditors and could complicate secured lending strategies.
Federal Rules of Bankruptcy Procedure changes (December 1, 2024)
Effective December 1, 2024, several procedural updates aimed to streamline and simplify bankruptcy processes took effect.
Restyled rules: The Federal Rules of Bankruptcy Procedure were restyled for clarity, with some changes in numbering but no intended change in substantive meaning.
Property recovery simplified: Individual debtors seeking the return of tangible personal property, such as a repossessed car, can now do so by motion, a much simpler process than a formal adversary proceeding.
Expanded scope of Rule 3002.1: A separate rule change expands the application of Rule 3002.1 to cases where the Chapter 13 plan provides for the trustee or debtor to make payments on a debt secured by the debtor's principal residence.

BILLY RICHARDS will arrive at The Sheraton Hotel @ Keystone Crossing next to the Fashion Mall before 7:00 am EST and is usually at the venue by 6:30 am EST.

TRAFFIC/CONSTRUCTION : There is a heavy volume of construction in/around the greater Indianapolis area and Carmel, Indiana where this event will take place. On the east side to the south side of Indianapolis. There are numerous construction areas and lane restrictions that will slow you down significantly around the Indianapolis area. We strongly encourage you use a navigation app/device like WAZE or your cell phone's MAPS App to get live updates as to traffic conditions. The Castleton area interchanges I-465 & I-69 corridor in particular have a high degree of construction and lots of daily accidents. Going through downtown Indianapolis is a daily challenge as well with very heavy construction throughout highways that flow throughout the downtown Indianapolis area. OF NOTE : The City Of Indianapolis is installing license plate readers with cameras in construction zones and drivers can receive traffic citations from these devices. The speed limit in these construction zones on highways is generally only 45 MPH, so be careful ! Also, GEN CON is the same weekend, so please be aware of hotel pricing and traffic from GEN CON.

Staff at The Sheraton tell me you can park behind the hotel or in the parking garage. All attendees will receive VALIDATED PARKING PASSES - FROM THE VENUE . It is your responsibility to be prepared in advance, arrive early, secure a validated parking pass, and submit your license number(s) and hours for CLE and/or CE.

If you want a USB Flash Drive, please let us know this ASAP so that we can have one for you on the day of the seminar. There is an additional $35 charge for a USB FLASH DRIVE. Otherwise, you will use the DropBox link. We only prepare a limited number of USB Flash drives with all the materials on them. If you do not pay for a USB Flash Drive, you will be using the DropBox link for the materials. Download the DropBox App in advance of the seminar.

COMPUTER/LAPTOP/TABLET
You will need a computer/tablet/ (or possibly use your phone) for this event. Using your cell phone is not really recommended because of the size of the materials AND length of the day for battery life. We no longer provide a paper manual to everyone as the cost of doing so is no longer cost effective for such a small event. As you may be aware, we have not raised the price of this event in over 20 years, while at the same time the cost of absolutely everything keeps going up. There is a limited number of power outlets in the room. Extension chords, power chords, juice paks are all encouraged to keep your deviced powered for a full day. Make sure you have the DropBox App and Zoom App downloaded to your device before the event begins. A hotel wifi password will be announced the morning of the event.

You will be added to the Zoom meeting room so you can follow along /watch this event should you arrive after 8:00am or should you need to leave before the end of the day, you can watch & listen via the Zoom link on your phone/tablet using the Zoom App for this meeting room. The Zoom meeting room will begin sharply at 8:00 am EST. If attending by Zoom, submit any questions in advance by email to me and I'll do my best to submit those questions to the appropriate segment of the seminar. Zoom attendees cannot jump in to the conversation as we go along.
