Our team got out of the office last Thursday to attend the Grateful Friends Spring Fundraising Luncheon. Grateful Friends is a wonderful organization that supports adults with cancer. By creating an estate plan, you ensure your wishes for managing and distributing your property are honored if you become incapacitated or die. It can also help avoid probate and the state’s default intestacy laws, preventing delays and unintended beneficiaries from receiving your assets.

Probate is the process by which title is transferred from the deceased to the beneficiaries.
Certain types of assets, called “non-probate assets,” do not go through probate. These include:
✅Property held in “joint tenancy with right of survivorship.” Such property passes to the co-owners by operation of law and does not go through probate.
✅Retirement accounts, such as IRAs and 401(k)s, with designated beneficiaries.
✅Life insurance policies.
✅Bank accounts with “pay on death” (POD) or “in trust for” designations.
✅Property owned by a living trust. Legal title to such property passes to successor trustees without going through probate.
