On January 21, 2022, Cheryl Augustine was driving through the intersection of Sunset and Allenford when a GMC Yukon turned left on a red arrow.

She was unconscious at the scene. She woke up at UCLA with a traumatic brain injury and bleeding on the brain, and underwent neurosurgery. Years later she still lives with the permanent effects — ongoing orthopedic and neurological problems, and profound changes to her personality and to her closest relationships.

The person who came home from the hospital was not the person who left the house that afternoon.

Arnold Schwarzenegger has now admitted that his negligence was the sole cause of the collision and of her injuries. So the jury seated in Dept. 205 will not be asked who was at fault. They will be asked what it cost her.

Trial begins Monday, October 12, 2026 at 8:30 a.m. — Beverly Hills Courthouse, 9355 Burton Way. Estimated two weeks.

Our client, a former professional cyclist, was hit by a 17-year-old driver, who turned too wide at a T-intersection and crossed into his lane. The collision caused a torn labrum, four broken ribs, a broken leg, and mild TBI symptoms, though he has nearly fully recovered.⁠
The key dispute was the point of impact. The driver claimed that the cyclist entered his lane, while our client, who was concussed and couldn’t recall the incident, could only testify that he would never ride on the wrong side of the road. Despite this challenge, the case resulted in a strong settlement.⁠
