Our client sustained neck and back injuries when her car was struck by the defendant's vehicle, which ran a red light. These injuries ultimately required a single-level C-spine fusion. The defense tried to attribute the symptoms and treatment to a subsequent, unrelated flare-up that our client experienced several months after the accident due to a reflexive flinch. We effectively dismantled this theory during expert depos, pressing the defendants’ experts until they were each forced to concede they could not anchor their entire causation argument to just a flinch. We further pinned them down on causation, getting them to admit the client was injured in this accident and would require future treatment for her injuries, and significantly undermined the defendants’ damages position.⁠
