What if an employee requests leave or an accommodation shortly before a termination decision is finalized?

This situation does not automatically make a termination unlawful. What it does is shift the scrutiny from the reason to the process.

Employers are often judged in these situations on three things: whether the termination decision was documented before the request came in, whether similar decisions have been handled consistently, and whether the timing can be explained clearly and without contradiction.

Good intent is not the question. A clean, defensible timeline is.

If your organization does not have a clear process for how termination decisions are documented and sequenced before they are communicated, this is worth addressing before it becomes a live issue.

Meet Ulysses. Senior cattle dog. Long-term shelter resident. Currently facing disciplinary review.

His documented offense: running full-speed across the yard and sliding directly into coworkers' feet without notice, consent, or a completed hazard assessment. He then circles until a belly rub occurs. He also presented a toy to the investigator. HR called it a bribe. Ulysses maintains it was a greeting. Nobody has been able to resolve this.

He is not sorry. This has been confirmed.

Here is the actual employment law takeaway: under Title VII and the Texas Commission on Human Rights Act, "he was just excited" is not a legal defense to an unwelcome physical contact complaint. Intent doesn't determine the violation โ€” impact does. The legal standard set in Harris v. Forklift Systems, Inc., 510 U.S. 17 (1993) is clear: a reasonable person standard applies, regardless of how soft the offender's ears are. If your workplace doesn't have a clear policy on physical conduct and a way to report it, you've got a rule that lives nowhere and protects nobody. That's fixable. We can help with your handbook. Ulysses needs a calm adult home with no other animals, a patient person, and someone who receives a full-speed running slide as the compliment it clearly is. He is an expert napper, a devoted co-pilot, and โ€” once he decides you're his โ€” fiercely loyal. He has never filed a complaint. He has been the subject of a few.

Meet Zeus. Nearly nine years old. Pit bull mix. 78 pounds of calm, cuddly, fully house-trained gentleman who sleeps with six plush toys, enjoys slow jams, wears hoodies unironically, and has a strict policy against kissing on the first date.

Adoption fee: $25.

Let that sink in.

Zeus has done everything right. He is trained, gentle, independent, road-trip-ready, and โ€” per his foster family โ€” will love you unconditionally once you earn his trust. He just wants a quiet home, one pet household, no small children, and somebody to tuck him in at night.

What he does not want is to keep being overlooked because he is a senior.

Here is a fun fact that is not actually fun: the American Society for the Prevention of Cruelty to Animals reports that senior dogs are adopted at significantly lower rates than younger dogs, despite being lower maintenance, better behaved, and already knowing how furniture works. It is age discrimination with a doggy door.

The Age Discrimination in Employment Act of 1967 (29 U.S.C. ยง 623) made it illegal to dismiss workers over 40 based on age rather than merit. No equivalent federal statute protects Zeus. That is where you come in.
