🌍✈️ Traveling Internationally with Your Child: Legal Considerations 🛂👨‍👩‍👧

Traveling internationally with your child can be an amazing adventure, offering cultural immersion and learning opportunities. However, when parents don't agree on travel plans, things can get complicated. Here's what you need to know:

1️⃣ Travel Consent Regulations: International parental kidnapping concerns have led to strict rules. Usually, both parents must consent to the child's international travel.

2️⃣ Passport Application: Kids need passports for international air travel. For children under 16, both parents' consent is typically required for the passport. Ensure you understand custody orders regarding passport possession and application rights.

3️⃣ Sole Managing Conservatorship: If you have sole custody, you can travel abroad with your child without the other parent's consent. However, you'll need to present the court-ordered custody arrangement for passport issuance.

International travel with your child involves legal responsibilities and consent from both parents. While exiting the US is relatively straightforward, entry into other countries often requires demonstrating parental agreement. Understanding these legal obligations and cooperating with the other parent ensures a smooth and enjoyable travel experience for both you and your child.

Ever heard of "nesting" in co-parenting? It's not just a cozy term—it's a parenting approach that prioritizes stability and continuity for kids during separation or divorce. 🧒

👶 What's Nesting? It's when the kids stay in the family home while parents take turns living there based on an agreed schedule. Kids enjoy a consistent living space, while parents manage custody responsibilities in a rotating fashion.

✅ Advantages:
1️⃣ Stability: Kids find comfort in their familiar home, minimizing the impact of a challenging family situation.
2️⃣ Less Disruption: No constant shuffling between homes; one stable home base for the children.
3️⃣ Shared Responsibilities: Both parents actively engage in the kids' lives and household duties.
4️⃣ Effective Communication: A must for successful nesting, enhancing co-parenting teamwork and communication skills.

CHANGES TO CHILD SUPPORT LAWS

Starting September 1, 2023, child support should be somewhat easier to collect, thanks to Senate Bill 869. Below is a summary of what has changed:

Child Support Arrears: If one party is behind on child support, the parties cannot agree to reduce or waive the arrears.

Inheritance: If a parent paying child support inherits money, they are not permitted to give that money to someone else as a means of getting out of child support.

Child Support Liens: Child support liens will no longer have a 10 year limit and, expired child support liens on real property can now be renewed.

Should I mediate my divorce or have a final trial?

There is no one way to finalize a family law case. There are many advantages to mediation instead of a judge making decisions about your life.

Advantages:
* You can save a lot of money by mediating instead of going to court
* Mediation can give parties a sense of ownership over their case
* Mediation can be a much faster way of resolving a case. It's not always easy getting into court!

If you would like to know more about the mediation process, or any other issue related to family law, please contact us at [email protected]
