Our litigation team notched another win. Bloom Parham secured summary judgment for a residential home builder client, winning the dismissal of all fourteen claims against it in a multi-party Georgia business dispute, including fraud, conversion, civil conspiracy, and RICO claims. After full briefing and oral argument, the Superior Court of Gwinnett County found no evidence connecting our client to the plaintiffs' alleged losses and dismissed every claim with prejudice. Congratulations to Simon Bloom, Stephen M. Parham, Alex Mooring, and Logan Berg on a complete pretrial victory for the client.

Bloom Parham has secured a partial reversal from the Georgia Court of Appeals that reopens the amount of damages available in a construction payment dispute. Representing the general contractor on a 160-unit senior living project, the firm convinced the court that the trial court's damages award could not stand on either of two issues because key parts of it were not supported by the evidence at trial. The decision sends the case back to the trial court to reassess damages issues, including losses by our client tied to a lien that a subcontractor's false affidavit had concealed. The win was led by Stephen M. Parham and Troy Covington.

Most parties who lose in the trial court never get a Georgia appellate court to hear them at all. Bloom Parham recently secured both discretionary review and oral argument before the Georgia Court of Appeals in a Carroll County zoning dispute, where the County approved combining our client's property and then refused to let the newly acquired portion be used for the wedding venue our client was already permitted to operate. Simon Bloom argued the case on June 3, assisted by Pierce Ostwalt, and the appeal is now under submission. Watch the oral argument here:

Bloom Parham has secured a reversal from the Georgia Court of Appeals protecting our client's right to pursue the full measure of its fraud damages at trial. Representing the purchaser in a failed apartment complex sale, the firm convinced the court that a buyer who was fraudulently induced into a contract may recover consequential damages in tort, even when the contract limits the remedies for breach. The decision reverses an order that had capped our client's recovery and significantly expands the damages it can now present to a jury, marking the firm's second successful appeal in this matter. The win was led by Managing Partner Stephen M. Parham and counsel Sean C. Ryan.

Bloom Parham partner Kurt Kastorf recently argued before the Supreme Court of Georgia in McLamb v. The Mayor and Aldermen of the City of Savannah (No. S26G0149), a case addressing immunity under Georgia's Recreational Property Act. The firm was brought on as co-counsel after the Court granted certiorari, to handle briefing and oral argument before the Georgia Supreme Court, and the case asks the Court to clarify when a government landowner may claim Recreational Property Act immunity. Following argument on June 17, 2026, the appeal is now pending, with a decision expected later this year. Kurt Kastorf, Simon Bloom and Pierce Ostwalt of the firm's appellate team are handling the matter.
